Labor market test - what was it and why did it disappear?
For years, the labor market test was one of the mandatory steps when hiring foreigners in Poland. The employer had to check whether there were any Polish candidates available for the position. In practice, this meant submitting a requisition to the labor office and waiting for the results of the procedure.
As of June 1, 2025, the labor market test is being phased out, as the Law on Employment of Foreigners has been amended. Its main goal is to simplify procedures and at the same time speed up the entire labor legalization process.
Why is the labor market test disappearing?
The reasons for this change are clear:
- Demographics - Poland's labor market continues to face a shortage of hands.
- Practice - The test in most cases ended with confirmation that there were no domestic candidates.
- Time - procedure extended the recruitment process by up to several weeks.
Therefore, the legislature decided to abolish this obligation, while opting for a system that is simpler, more transparent and faster to implement.
