Work permits for foreigners 2025 are entering a new, much more restrictive phase. The meeting, held on November 13 at the Mazovian Provincial Office with the participation of the Ministry of Family, Labor and Social Policy and representatives of the government administration, confirmed one thing: the direction of change is clear - greater control, verification of actual employment and reduction of abuses.
From the perspective of the NJOB, this means the need for even more precise planning of processes related to the legalization of foreign labor, as well as a conscious approach to the model of cooperation with companies using process outsourcing.
New regulations and work permits for foreigners 2025
The new law regulating the permissibility of entrusting work to foreigners introduces additional prerequisites for refusing to issue a permit and the requirement for a detailed analysis of each case. Importantly, the offices examine not only the formalities, but also the reality of the activity.
The main reasons for refusal include:

No active activity of the employer (suspension, liquidation, deletion),

activities aimed mainly at "facilitating entry" of foreigners,

planned start date of more than 12 months from the date of application,
-
Entrusting work to a third party by an entity that is not a temporary employment agency,
-
No actual activity of the employer-user.
What's more, applications are now processed only on a first-come, first-served basis, with no expedited procedures - at least until the deficit occupations are fully defined.
Transition period and its impact on the market
The administration confirmed the validity of the transition period, which will end on November 31. At the same time, employers must adjust their operations to the new reality, which in practice means possible longer waiting times for decisions.
From the point of view of the NJOB, this is the moment when advance employment planning and professional support in the preparation of correct documentation become crucial.
Deficit occupations and the zipper method
Work is underway on a list of deficit occupations that will be considered on a priority basis. At the same time, it is planned to implement the so-called zipper method and further digitization of processes.
Nevertheless, this could lead to even greater stratification of industries:

Process outsourcing under the magnifying glass of administration
In the context of the changes under discussion, it is particularly important to distinguish between models of cooperation. The administration clearly indicates that:

Fraud in this area is easy to detect and is a frequent subject of scrutiny.

The new rules require precise indication of the place of work. For production workers, who make up as much as 80% of applications, specifying several locations now raises serious concerns.

Tripartite employment - only for temporary employment agencies!
The employee-agency-user-employer model remains permitted only for certified temporary employment agencies. The administration aims to seal the system as much as possible, while stressing that despite staffing deficits, worker safety remains a priority.
