Legal employment of foreigners in Poland as of June 1, 2025 has undergone a real revolution. The new law on the employment of foreigners not only moved all procedures to the Internet and abolished the labor market test, but also explicitly regulated the issue of working on a Schengen visa.

Until recently, many employers and employees treated a visa from another EU country as a gateway to employment in Poland. Today, that no longer works - and anyone who decides to take such a step risks serious consequences.

What is a Schengen visa?

A Schengen visa allows a foreigner to travel freely within the Schengen area for a maximum of 90 days within 180 days. It is, however residence document, and not work permit. This means that a person with a French, German or Italian visa can come to Poland as a tourist, visit family or arrange business matters, but cannot legally take up employment.

What has changed in the regulations?

As of June 1, 2025, a clear provision has been introduced:
A Schengen visa issued by another member state does not entitle you to work in Poland.
To work legally, it is necessary to have:

  • work permit or
  • statement on entrusting work to a foreigner.

Lack of these documents means illegal employment - and this risks a fine of up to PLN 50,000 for the employer and consequences for the employee.

The most common myths and misconceptions

❌ "Since I can enter on a visa, I can also work" - NO. Residency and work are two different things.
❌ "My agency said that a visa is enough". - NO. Agencies acting illegally put companies and workers at risk.
❌ "It's only for a few weeks, no one will know" - NO. The new electronic system quickly catches any illegal employment.

Legality of employment is not only about avoiding penalties. It is also the employee's security (insurance, benefits, stability) and the employer's certainty that he will not be charged with sanctions. Clear rules make the labor market more transparent and secure for both parties.
